These terms apply to HubSpot Onboarding packs bought online from UpLaunch Pty Ltd (ABN 59 680 161 086). By completing this purchase you agree to them and to our Terms and Conditions at uplaunch.com.au/terms. If there is any inconsistency, these onboarding terms apply.
1What's included
The number of expert sessions in your pack, delivered by an UpLaunch specialist by video call, an onboarding plan for your business, and access to our onboarding videos. You build HubSpot in your own portal and we help you.
2Validity
Your sessions and video access are valid for 90 days. Your end date is shown in your onboarding document and email. It's your responsibility to book and attend your sessions before that date. Sessions not used by then expire, whether or not any have been used, and can't be refunded, extended, carried over or transferred.
3Sessions
Each session runs for 30 minutes and is booked through our online calendar, during UpLaunch business hours (Sydney time). You choose what to cover in each session, such as questions about your onboarding plan or your build. They can't be used for UpLaunch to do work for you, such as building or configuring HubSpot, importing data, setting up integrations or custom development. We can quote for that work separately, or it can be done with a support pack. If you need to reschedule, give at least 24 hours' notice. A session cancelled with less notice, or missed, counts as used. Bookings beyond the number of sessions in your pack are cancelled automatically. Extra time can be covered with a support pack.
4If we need to reschedule
If we cancel a session, it doesn't count as used and we'll reschedule it. If we can't offer you enough session times before your end date, we'll extend your end date.
5Your responsibilities
You need an active HubSpot subscription with the right hubs and seats, admin access for the people building, and to do the build work between sessions. HubSpot fees are paid directly to HubSpot and are not part of this purchase. You're responsible for the changes made in your HubSpot portal, including imports and deletions, and for keeping backups of your data.
6Payment and refunds
Prices are in Australian dollars, with GST added where it applies. Payment is due in full at purchase. To the extent permitted by law, all fees are non-refundable, including if you change your mind, don't book or attend sessions, or don't use some or all of your sessions. This doesn't affect your right to a remedy if our service fails to meet a consumer guarantee.
7Our materials
Your onboarding document, the onboarding videos and your access code are for your own business only. You can't share, resell or publish them.
8HubSpot and other platforms
UpLaunch is an independent HubSpot partner. We are not responsible for HubSpot or other third-party platforms, including their pricing, features, outages or data.
9Results
Our guidance is given with care and skill, but we don't guarantee any particular business result. You decide what to build and how to use HubSpot.
10Liability
To the extent permitted by law, we are not liable for indirect or consequential loss, including lost profits, revenue or data. Where our liability can't be excluded, it's limited, at our option, to supplying the services again or paying the cost of having them supplied again.
11Your consumer rights
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or, in New Zealand, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, that cannot lawfully be excluded. If you are in New Zealand and buying for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply, to the extent the law allows.
12Privacy
We handle your personal information in line with our Privacy Policy at uplaunch.com.au/privacy.
13Governing law
These terms are governed by the laws of New South Wales, Australia.
